These Terms of Service ("Terms") govern your use of the MOMENTS mobile app and related services ("the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who can use MOMENTS
You must be at least 18 years old to create an account. A parent or legal guardian may create and manage an account on behalf of a minor or other person in their care, and is responsible for that use. By using the Service you confirm that the information you provide is accurate.
2. What MOMENTS does
MOMENTS lets you record seizure events and related details, view your own history, and — if you choose — share that information with supporters you invite so they can help track and respond. The Service is a record-keeping and communication aid only.
3. Medical disclaimer
The Service is not a substitute for professional medical advice, diagnosis, or treatment. Notifications are provided on a best-effort basis and may be delayed or fail to deliver due to factors outside our control (device settings, connectivity, or third-party delivery systems). Never rely on the Service for emergencies or continuous safety monitoring. Always seek the advice of your physician or other qualified provider with any questions about a medical condition.
4. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly if you believe your account has been compromised. You are responsible for the accuracy of the information you enter.
5. Sharing and your care circle
You control who you invite as a supporter. When you share your log, you understand that the supporters you invite can view the information you share and may receive notifications about it. You are responsible for choosing whom to invite and for removing supporters when appropriate. If you join as a supporter, you agree to use another person's information only to support them and to respect their privacy.
6. Acceptable use
You agree not to misuse the Service, including by: accessing accounts or data that are not yours; attempting to disrupt, reverse-engineer, or compromise the Service; uploading unlawful or harmful content; or using the Service to harass others. We may suspend or terminate accounts that violate these Terms.
7. Purchases
The Service may offer optional paid features in the future. Any purchases will be processed by the applicable app store (Apple App Store or Google Play) under their terms. Pricing and details for paid features will be presented in the app before purchase, and this section will be updated accordingly.
8. Your content
You retain ownership of the information you enter into MOMENTS. You grant us the limited permission needed to store, process, and display that information to you and the supporters you designate, solely to operate the Service. We claim no ownership of your seizure logs.
9. Intellectual property
The MOMENTS app, its name, logo, design, and software are owned by us and protected by law. These Terms do not grant you any right to use our branding except as needed to use the Service.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that notifications will always be delivered.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of — or inability to use — the Service, including any reliance on its records or notifications. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the United States and the state in which the developer resides, without regard to conflict-of-law rules.
